Palmdale DMV Hearings Lawyer

Guiding Our Clients Through DMV Hearings in California

If you were recently arrested for DUI and if you received notification that the DMV intends to take action against your driving privileges, then you must request an administrative hearing within 10 days of receiving personal service or within 14 days from the date the notice was mailed. If you do not make your request within the allotted time frame, your opportunity for a hearing will be forever lost.

Were you recently arrested for DUI? Call (800) 860-1383 to see how our
defense attorneys can save your license and fight your charges!

The purpose of the administrative hearing is to provide you with the opportunity to present any relevant evidence or testimony on your behalf regarding an action or the intent to take action against your driving privileges by the DMV. You also have to appear in court in reference to your DUI charges; however, the DMV administrative hearing is a separate hearing and only addresses your driving privileges and not your criminal charges. All criminal proceedings are independent of any actions taken by the DMV to suspend
your driving privileges.

WILL I LOSE MY LICENSE FOR DUI?

DUI in California is a very serious offense and can lead to a great deal of hardship and unwanted repercussions, punishments that include losing your driver’s license. This can leave you with many questions and concerns about achieving important day to day activities. How will I get to and
from work? Will I lose my job because of this inability to drive legally? How will I meet my family’s needs? Putting you in this position can truly change your life drastically and put you in an untenable situation.

After a first time DUI conviction, it is quite normal to have your license revoked for a period of 4 months. Suspension up to a full year may occur if you refused to submit to chemical testing after you were arrested.
Repeat convictions can lead to 1-2 year license revocation. It is possible to pursue a reduction in the length of your license suspension or even a full dismissal of your revocation, but swift action is needed to seek
these options.

TEAM UP WITH A LAWYER – KNOW YOUR RIGHTS AT THE ADMINISTRATIVE HEARING

At the administrative hearing you have the right to be represented by an attorney, but representation is not required; you have the right to review and cross-examine the testimony of any witness for the DMV; you have the right to present evidence and any relevant witnesses in your defense; and you have the right to testify on your own behalf. Also, if you are not satisfied with the DMV’s decision regarding your case, you have the right to request a department review of the decision and you have the right to appeal the decision to superior court.

When facing DUI charges and the loss of your driver’s license, you could not only lose your mobility, but your livelihood by not being able to drive. Our attorneys have been representing clients in 3-5 DMV hearings per week for 15+ years. This experience and knowledge could be crucial in your case. Our team cares about getting the results you need, and we will work diligently to preserve your legal rights.
