The purpose of the administrative hearing is to provide you with the opportunity to present any relevant evidence or testimony on your behalf regarding an action or the intent to take action against your driving privileges by the DMV. You also have to appear in court in reference to your DUI charges; however, the DMV administrative hearing is a separate hearing and only addresses your driving privileges and not your criminal charges. All criminal proceedings are independent of any actions taken by the DMV to suspend
your driving privileges.

these options.
At the administrative hearing you have the right to be represented by an attorney, but representation is not required; you have the right to review and cross-examine the testimony of any witness for the DMV; you have the right to present evidence and any relevant witnesses in your defense; and you have the right to testify on your own behalf. Also, if you are not satisfied with the DMV’s decision regarding your case, you have the right to request a department review of the decision and you have the right to appeal the decision to superior court.
