INTERVIEW WITH DAVID WALLIN
WHAT MADE YOU WANT TO BECOME A CRIMINAL DEFENSE ATTORNEY?
I was a Deputy District Attorney for almost 5 years and in that time I saw many things I wish I hadn't. Law Enforcement not being honest simply to obtain convictions, D.A.'s with power-trips and a system that seemed more about convictions and punishment and ruining people's futures, than about justice. So I knew I had to leave the D.A.'s office and try to help people against 2 million dollar agencies (i.e. the D.A.'s office and the Sheriff's Department) that had everything at their disposal to go after the little guy. I'm here to even the odds for everyday people, every day.
IN YOUR OPINION, WHAT SETS YOUR FIRM APART FROM THE REST?
What sets us apart is that we genuinely care about obtaining the best outcome for our clients. We not only don't mind, but find it our mission to fight for the people that need it the most, against a system that is increasingly harsh and unyielding. We know we are fighting for our clients' entire future and reputation in many cases, and we don't take that lightly.
WHY SHOULD SOMEONE CHOOSE TO HIRE YOU OVER A PUBLIC DEFENDER?
Public defenders are good people, for the most part, doing an impossible job. They handle typically 15 to 30 cases, each and every day. Public Defenders simply don't have the time to devote to mount a vigorous defense in most cases. Our office, on the other hand, cares more about the result for our client, than the time it takes to get it. Our office spends the time necessary to fight for our clients, and we have the resources to go up against a criminal justice system that needs to be shown that the people they prosecute aren't just a case number and a charge, but are human beings that deserve to be heard and fought for. We are proud to take on that task.
WHAT IS THE FIRST THING YOU DO WHEN YOU TAKE ON A NEW CASE?
The first thing we do when we take on a case is to try to find out exactly what the allegations are against our client, and then we mount a vigorous defense to those allegations. We go over the police report and find the problems with their case, and we show the D.A.'s office our side of the case. In doing so, we try to get the charges dismissed or reduced.
HOW DO YOU VIEW YOUR ROLE IN THE ATTORNEY-CLIENT RELATIONSHIP?
We have several roles in the attorney/client relationship. Of course we serve as experts at Criminal Defense, working with our client and their loved ones, to help them see where we can help them legally. We also see our role as their friend that helps our clients and their families navigate a system that can be harsh and cruel. We try to help them through the process to take from them as much anxiety as possible, while we are fighting their case for them.
WHAT ADVICE DO YOU MOST OFTEN GIVE YOUR CLIENTS AND WHY?
The advice we give at our office is to ask questions. Ask lots of questions. Most of our clients don't understand the criminal justice system, and we hope to help them understand the world we live in every day. We believe knowledge is power, and we want our clients to feel empowered and knowledgeable about every facet of their case at all times.
TELL US ABOUT A CASE THAT YOU ARE PARTICULARLY PROUD OF:
I've handled close to 10,000 cases in my 27 years, but if I had to pick one case, a client that stands out was a 16 year old girl charged with murder. After having a baby in the bathroom toilet, she put it in a bag, and hid it her bedroom closet so her mother wouldn't know. After we were retained, we kept her out of custody while we fought the case for about a year. We resolved the case with a dismissal of the murder charge and obtained a reduction to manslaughter. We also obtained NO TIME IN JAIL for her. I'm very proud of the work my office did on that case.
SOME SAY THAT TIME IS OF THE ESSENCE AFTER AN ARREST – IS THIS TRUE?
It can be. The earlier that one contacts an attorney, there is a better chance for a better outcome. Also, when we get a case early enough, we are sometimes able to get the charges dropped and NO CASE is filed.
HOW LONG HAVE YOU BEEN REPRESENTING THE CRIMINALLY ACCUSED?
My offices have been representing people accused of crimes for over 27 years, representing 1000's of good people caught in a bad situation.
WHY SHOULD A PROSPECTIVE CLIENT CHOOSE TO WORK WITH YOUR FIRM?
If a person is being accused of a crime, they need a law firm who A) CARES about who they are, B) IS HONEST, C) DOESN'T overcharge them, and D) WILL FIGHT FOR THEM. We ARE that law firm. And I'm BLESSED to be put here to help everyday people, every day.
