California law describes grand theft as the unlawful taking of another person's property that is valued above $950. Grand theft is known as a "wobbler" as it can be charged as either a misdemeanor or a felony, depending on the circumstances of the case and the criminal history of the defendant. If it is charged as a felony, it can also count as a "strike" under California's Three Strike law (a law that can add significant to penalties to someone charged with three felonies). A charge of grand theft can carry penalties such as one year in a county jail for a misdemeanor, or up to three years in prison for a felony.

In some cases a person can be charged with grand theft if the value of the property was under $950, such as:

  • Items stolen from an employer total more than $950 in a 12-month period
  • A firearm was taken (known as "grand theft firearm" or GTF)
  • An automobile was taken (known as "grand theft auto" or GTA)
  • The property taken was carried by another person (known as "grand theft person")
  • Property taken was a certain animal (such as a horse, sheep, or pig)
